CONTEST DATES: The Start Date of the contest is 9:00 a.m. Central Time, February 10, 2012 and the End Date of the contest is Midnight Central Time, March 31, 2012. No entries will be accepted before the Start Date or after the End Date.
SPONSOR AND PROMOTER: The sponsor of this contest is Coughlan Companies, Inc. d/b/a Capstone (ԃapstoneԠor ԓponsorԩ with an address at 1710 Roe Crest Drive, North Mankato, MN 56003.
Encourage students to imagine a character who would be the next best member of the Revolution. Students should describe the traits and characteristics that this character might have by answering the questions in the entry form at www.TonyHawkReadingRevolution.com/contest. The entry should be unique and inspiring! Please be sure to include your name, phone number and email address so that we can notify you if you are a winner. All prospective winners and their respective parents/legal guardians will be required to sign, notarize, and return an affidavit of eligibility/release of liability within ten (10) days of date of notification or an alternate winner may be selected.
Contest is open to students currently enrolled in public or private schools in grades 3 ֠7 in the United States and who are lawful residents of the United States. Entries should be submitted by students with the approval and permission of a custodial parent or legal guardian. Once an entry has been submitted it becomes the property of Capstone and entrant assigns all right, title and interest in the entry to Capstone. Entries will not be returned. Capstone is the sole sponsor of this contest. Persons in any of the following categories are NOT eligible to participate or win prizes in the Contest: (a) persons who on or after the Start Date, were or are employees or agents of Capstone, or its subsidiaries, or their subsidiaries, or their respective affiliated companies, franchisees, or service agencies, or independent contractors (including but not limited to all sales representative organizations); (b) individuals engaged, or employed by a company that is engaged, in the development, production or distribution of materials for this Contest; and (c) persons who are immediate family (defined as mother, father, sister, brother, daughter, son or spouse) of any person in any of the preceding categories, regardless of where they live; or who reside in the same household, as any person in any of the preceding categories, whether related or not. Limit one entry per person. Subsequent entries submitted by a single entrant are void.
First Place: There will be one (1) First Place prize. The winning character/avatar will be featured in an upcoming Tony Hawkӳ 900 Revolution book. The First Place winner will receive five copies of the book. The First Place winner will also receive round-trip air transportation and lodging to Tony Hawkӳ Stand Up For Skateparks 2012 event in Beverly Hills and a VIP pass to meet Tony Hawk! Air transportation will be two (2) coach class airplane tickets from the closest major airport to the First Place winnerӳ residence in the United States, to be booked by Capstone. The First Place winner must contact Capstone at least thirty (30) days in advance of travel to book travel and accommodations. Accommodations while in Beverly Hills will be one nightӳ lodging at a hotel selected by Capstone. The First Place winner will also receive two (2) tickets to the 2012 Stand Up for Skateparks Event. Sponsor is not responsible for any additional costs incurred by First Place winner associated with the trip. The cash value of the prize depends upon the actual travel dates, winnerӳ point of departure and travel costs at the time of booking. If winner lives within a one hundred (100)-mile radius of the Beverly Hills, ground transportation may be provided in lieu of air transportation and no compensation or substitution will be provided for any difference in prize value. Winnerӳ point of departure must be a major airport located within the United States of America that is approved by sponsor at its sole discretion. Winner is responsible for all travel costs to and from the point of departure. The Prize trip must be taken at time and flight itinerary specified by sponsor in sponsor's sole discretion or Prize will be forfeited in its entirety. Sponsor shall not be responsible for any cancellations, delays, diversions or substitution or any act or omissions whatsoever by the air carriers, hotels or other transportation companies or any other persons providing any of these services and accommodations necessitated by same. All travel dates are subject to change in sponsorӳ sole discretion. Air travel and hotel accommodations are subject to availability and any changes made to either of these will be at the expense of the Winner. Winner and guest will be required to travel together on the same itinerary and be responsible for obtaining all required travel documents (photo identification). Winner and guest are responsible for obtaining travel insurance (and all other forms of insurance) at their option and hereby acknowledge that Sponsor has not and will not obtain or provide travel insurance or any other form of insurance. Guest traveling with winner must be the age of majority in the jurisdiction in which he/she resides at time of trip fulfillment, or guest must be a family member of Winner. No refund or compensation will be made in the event of the cancellation or delay of any flight except at the sole discretion of Sponsor. Travel is subject to the terms and conditions set forth in this promotion, and those set forth by Sponsor's airline carrier of choice as detailed in the passenger ticket contract. Lost or stolen airline tickets will not be replaced or exchanged.
Top 5 finalists: There will be five (5) Top 5 finalist prizes. Each of the top five finalists will win a Tony Hawk autographed copy of Drop In, Vol. 1. The estimated cash value of the Top 5 finalist prize is $20.
Top 50: There will be fifty (50) Top 50 entrants prizes. Each of the Top 50 entrants will receive two Tony Hawkӳ 900 Revolution books, one for the student and one for the school library. The estimated cash value of the Top 50 entrants prize is $40.
Any and all prize-related expenses, including without limitation all federal, state and local taxes, are the sole responsibility of the winners.
Odds. The odds of winning will be determined by the total number of eligible entries received and the quality of the entry as this is a judged contest and not a random award.
After all entries have been submitted, the contest judges will choose the top fifty entries and the top five entries. Judging will be conducted under the supervision of Capstone, whose decisions are final and binding on matters relating to this contest. Sketches will be drawn for the Top 5 entries and posted to www.TonyHawksReadingRevolution.com. Persons across the country will then be able to vote for the sketch of their favorite character. The Top 5 finalist that receives the most valid votes will be declared the First Place Winner.
ENTRIES TO BE ORIGINAL WORK:
Entrant represents and warrants that all entries are the original creation of the entrant. Entrant represents and warrants that their entry does not defame or invade the rights or privacy of any person, living or deceased, or otherwise infringe upon any third party personal or proprietary rights. Any entrant whose work includes likenesses of third parties or contains elements not owned by the entrant (such as, but not limited to trademarks or logos) must be able to provide legal releases, licenses and permissions for such use in a form satisfactory to judges. Entry may not be offensive, as determined by judges in their sole discretion.
NOTIFICATION OF WINNERS:
Winner will be notified by phone or email on or about May 4, 2012. The winners must confirm acceptance of the prize by completing a declaration of eligibility within ten (10) days of winning notification. If the winner does not claim the prize, confirm acceptance or otherwise comply with all official rules within the required time frame, the Sponsor, at Sponsorӳ sole discretion, may select a substitute winner by the same method.
Entries will be void if they are incomplete, late, lost, or are not able to be viewed due to technical error. By entering, entrants acknowledge compliance with these official rules including all eligibility requirements. All entries become the property of Capstone and will not be returned.
ASSIGNMENT OF RIGHTS:
By submitting an entry in connection herewith, Entrant unconditionally assigns and transfers to Sponsor all rights, title, interest and claim, which it now has or may in the future have to entries (including, without limitation, the submitted character), whether acceptable or not regardless of the form they take, or any element(s) thereof including, without limitation, the copyright, trademark rights, right of publicity or any other rights therein and further grants and assigns to the Sponsor the right to use, copy, publish, distribute, exploit, create derivative works and/or modify any entry and/or character submitted in connection herewith in any manner it wishes. Entrant waives and releases all moral rights or rights of integrity or attribution in the entry. Sponsor reserves the right to modify submitted character and publish or advertise without approval, acknowledgement or compensation unless prohibited by law.
GENERAL TERMS AND CONDITIONS:
By participating in this Contest, Entrant agrees to be bound by these rules and by the decisions of Sponsor and judges, which are final and binding in all respects. Enternats agree and hereby release, discharge and hold harmless Sponsor, its subsidiaries, affiliates, related companies, agencies, agents and representative and the officers, directors and employees of each from any and all claims, charges, injuries, liability, loss, misdirection of the prize or any other claim arising out of the Contest. By entering, each entrant transfers all rights to the content of his/her entry and the ideas/concepts embodied therein. Sponsor shall have the right to modify, use, assign or dispose of such entries however they see fit without approval of entrants or any third party. Entrants grant Sponsor the right to use their names, images, likenesses, photographs, voices and biographical materials, and submissions, for advertising, publicity and promotion purposes including posting the character online for any purpose or on a winnerӳ list and other online announcements, and for sharing the character with the media for viewing, whether TV or print, without additional compensation, unless prohibited by law. Neither entrants nor winner shall receive any compensation or credit for use of entries, other than that disclosed in these rules. Transfer of prizes or registrations is strictly prohibited. Cash substitutes for prizes will not be awarded. The Contest is void in whole or in part where prohibited by law. Winners may be required, as a condition of receiving a prize, to sign and return within a specified time, a declaration of eligibility, liability release, publicity release, and any other forms or documents required by Sponsor or by tax or other governmental authorities. Should an Entrant make any false statement in any document referenced above, Entrant may be required promptly to return Entrantӳ prize to Sponsor. Sponsor is not responsible for incorrect, incomplete, inaccurate, illegible, misdirected, late, lost or delayed entries, which may be disqualified, whether caused by technical malfunction or human error. Entrant is solely responsible for submitting the official entry. Sponsor is not responsible for lost or stolen entries. Any attempt by any Entrant to deliberately interfere with or damage the Contest, modify entries, or undermine the legitimate operation of the Contest may be a violation of criminal and civil laws and may result, among other things, in disqualification from the Contest. Subject to any governmental approval which may be required, Sponsor reserves the right, without prior notice and at any time, to terminate or suspend the Contest, in whole or in part, or to modify the Contest in any way, should any factor (including but not limited to fraud or security breach) interfere with the ContestҠproper conduct as contemplated by these Official Rules, or if the Sponsor believes that the Contest has been or will be compromised in any way. Sponsor reserves the right to void any entry submitted for a prize, if it believes such entry was submitted other than through regular channels of business as contemplated by these Official Rules or that the entry has been tampered with in any manner. By entering, entrants agree to indemnify, defend, release and hold harmless the sponsor and their agents from and against any claims, action and/or liability for injury, loss or damage of any kind resulting from participating in this promotion or from the acceptance or use of prize awarded. Sponsor reserves the right to verify eligibility qualifications of the winner. The laws of the State of Minnesota govern the contest and contest rules.
